Terms of Service

These Terms of Service ("Terms") govern your use of YURN, an SMS marketing platform that lets merchants send offers by text message to customers who have opted in ("Service"). By creating an account or using the Service, you agree to these Terms. If you are using the Service on behalf of a business, you represent that you have authority to bind that business.

1. The Service

YURN provides merchants with tools to collect text-message opt-ins via QR codes and keywords, compose and send SMS offers, and track claims and redemptions. YURN is not a party to any transaction between a merchant and a consumer. A claim on a YURN offer is not a payment, reservation guarantee, or contract of sale; honoring the offer is solely the merchant's responsibility.

2. Accounts and eligibility

You must be at least 18 years old and operate a lawful business to use the Service as a merchant. You must complete email verification and business verification before sending. You are responsible for all activity under your account and for keeping access credentials secure.

3. Consent and messaging rules

  • Messages may be sent only to consumers who opted in by sending a consumer-initiated text message (e.g. "JOIN" plus your keyword). You may not import, purchase, or upload contact lists.
  • Opt-out keywords (STOP, MUTE) are honored automatically by the platform and may not be circumvented. START re-subscribes a consumer after STOP; HELP returns program information.
  • Sends are restricted to 9:00 AM – 8:00 PM in the consumer's local timezone. Scheduled sends outside that window are deferred.
  • YURN monitors opt-out and complaint rates per merchant and may throttle or suspend sending automatically to protect deliverability for all customers.

4. Merchant content representations

For every offer you submit, you represent and warrant that:

  • it is a genuine commercial offer from your business, with accurate pricing, a real expiration, and a stated redemption method;
  • it does not involve prohibited content, including sex, hate, alcohol offers without age gating, firearms, tobacco, cannabis, controlled substances, gambling, or lending and debt-relief services;
  • it makes no deceptive claims — including false urgency, misleading discount math, unsubstantiated health claims, or income guarantees;
  • you own or are licensed to use all content you submit, and it does not infringe any third party's rights;
  • your use of the Service complies with all applicable laws, including the TCPA, the CAN-SPAM Act where applicable, CTIA messaging guidelines, and state consumer-protection laws.

Every offer passes automated review before sending, and YURN may reject, escalate for human review, or remove any offer at its discretion. Review does not shift responsibility for content: your offers remain yours.

5. Indemnification

You will defend, indemnify, and hold harmless YURN, its officers, employees, and agents from and against any claims, damages, fines, penalties, and expenses (including reasonable attorneys' fees) arising out of or related to (a) the content of your offers and messages, (b) your products, services, or dealings with consumers, (c) your breach of these Terms, or (d) your violation of applicable law, including telecommunications and consumer-protection law.

6. Fees and billing

The Free tier is provided at no charge subject to its follower and send caps. The Pro tier is billed monthly in advance at the published price. Fees are non-refundable except where required by law. YURN may change pricing with at least 30 days' notice; continued use after the change takes effect constitutes acceptance.

7. Suspension and termination

You may cancel at any time from the portal. YURN may suspend or terminate accounts that violate these Terms, exceed complaint thresholds, fail verification, or create risk for the platform's sending reputation. Consent records are retained after termination as described in thePrivacy Policy.

8. Disclaimers and limitation of liability

The Service is provided "as is." SMS delivery depends on carriers and is not guaranteed. To the maximum extent permitted by law, YURN disclaims all implied warranties and will not be liable for indirect, incidental, special, consequential, or punitive damages, or lost profits or revenue. YURN's total liability for any claim is limited to the fees you paid in the twelve months before the event giving rise to the claim, or $100 if you paid none.

9. General

These Terms are governed by the laws of the State of Delaware, excluding its conflict-of-law rules. If any provision is unenforceable, the rest remains in effect. YURN may update these Terms; material changes will be announced by email or in the portal at least 14 days before they take effect. Questions:[email protected].
